RECOVERING FROM THE PARENTS OF MINORS - Parental Responsibility - Ottawa Personal Injury Lawyers - www.pqtlaw.com

The Parental Responsibility Act is an Ontario law that can make parents responsible for the intentional actions of their children. This law holds parents financially responsible for property loss, damage or destruction intentionally caused by their children who are under 18 years of age. It allows property owners, renters, lessees whose property has been intentionally damaged, destroyed, or stolen by minors to bring a claim for a maximum of $10,000.00 through Small Claims Court. This amount includes costs incurred by the victim such as lost wages or profits and car rental costs arising from the property damage or loss; and permits victims to use documents under the federal Young Offenders Act and Youth Criminal Justice Act to help prove their case where the youth has been found guilty of that property offence in youth court. Retaining a lawyer: a matter of choice

Retaining the services of a lawyer to defend and protect your interests is a matter that involves more than making a simple telephone call. Anthony Mineault, an associate lawyer with Plant Quinn Thiele LLP, maintains that prior to forging a relationship with a law firm potential clients should always exercise due diligence and not be afraid to ask questions about the law firm’s experience, the nature of the proceedings and the potential outcomes associated with a specific proceeding. Choosing a lawyer to represent your interest is not a matter of convenience, but a matter of choice. Potential client’s should choose a lawyer based on their belief that they can be comfortable in confiding information and in trusting the lawyer’s ability to bring a successful outcome. Potential clients should always be allowed to take their time when it comes to choosing legal representation. Such an important decision should never be rushed and should be made on the basis that the potential client feels comfortable in dealing with the contacted lawyer.

Mr. Mineault was recently retained by a young family residing in Eastern Ontario who had been injured in a motor vehicle accident in 2007. The family had telephoned Mr. Mineault, as well as several other personal injury law firms, on several occasions to discuss the case with him. The family was unaware of their legal right to sue the at fault driver or of their rights to receive accident benefits under their automobile insurance policy. It was the family’s first experience in dealing with an insurance company and they felt overwhelmed by their experience. Mr. Mineault took the time to speak with the family and to explain the rights available to victims of motor vehicle accidents during each telephone conversation. Mr. Mineault drove outside of Ottawa to meet with this young family and to discuss the extent of their rights and entitlements. The family was quite pleased to have a lawyer come to the comfort of their home to explain all of the intricacies related to motor vehicle litigation in Ontario. Mr. Mineault was officially retained to pursue and protect their interests. Ottawa Personal Injury Lawyers - Plant Quinn Thiele LLP - www.pqtlaw.com

LIMITATION PERIODS AND ACCESS TO JUSTICE

Mr. Marc Quinn, managing partner at Plant Quinn Thiele LLP, today celebrates 12 years at the bar with his law partners.  Upon being asked how access to justice has changed over the years, Mr. Quinn noted that in many ways the insurance industry has persuaded government to restrict the rights of injured persons to recover damages for their injuries.  The most significant change in this regard is that the time to sue has been changed from 6 years to 2 years.  This means that many personal injury victims will lose their right to compensation for injuries they suffer.  This change in the law highlights the fact that anyone injured in Ontario should immediately take advantage of a free legal consultation as offered by Plant Quinn Thiele and make sure that their rights are protected.  Given that missing a limitation period can prevent recovery every injured person should seek legal advice as soon as possible after the injury.  Ottawa Personal Injury Lawyers- Plant Quinn Thiele LLP - www.pqtlaw.com

ACCESS TO JUSTICE AND CONTINGENCY FEES

Michael Thiele is today celebrating his 12th year of being called to the Bar of Ontario.  It has been 12 very good years of helping clients fight their cases and obtaining justice for them. Upon being being asked how access to justice has changed over that time Mr. Thiele noted that contingency fees--no fee until you win or settle-- as offered by Plant Quinn Thiele LLP were not actually a permitted practice in Ontario in 1997.  The change in the law allows Plant Quinn Thiele's personal injury client's  to pursue cases even though they do not have the money for litigation expenses. Plant Quinn Thiele LLP assumes the risk of those costs for the client and only gets reimbursed from a settlement or judgment.  This change in the law is a tremendous increase in access to justice for clients of Plant Quinn Thiele LLP.  Ottawa Personal Injury Lawyers-Plant Quinn Thiele LLP-- www.pqtlaw.com
